Operational restructuring

The last few years have shown that management must follow new paradigms, risks have increased significantly in recent years and volatility on the financial markets has become a permanent condition. Digital achievements are attacking established competitive advantages.

Out-of-court restructuring

Corporate crises have a wide variety of triggers and can be the result of a number of causes. However, they often become apparent because a further financial requirement arises and the financing partners demand a restructuring concept or a going concern forecast. Nevertheless, every crisis situation is unique.

This makes it all the more important to have the specialist knowledge required to overcome these crises. Our interdisciplinary experts in restructuring, organizational and process consulting use this expertise to the benefit of your company and regain the trust of all parties involved.

Judicial restructuring

Do I have to file for insolvency?

In the context of a crisis, it can also happen that individual stakeholders want to rule out the possibility of filing for insolvency. We can also help here and assess whether there are grounds for filing for insolvency, such as over-indebtedness or inability to pay, as part of an IDW S11 audit. 

In this context, we are also familiar with the StaRUG (Act on the Stabilization and Restructuring Framework for Companies) and can discuss with you which restructuring and reorganization options are available to you in the event of imminent insolvency.

What do you need to consider in the event of insolvency?

If it turns out that the financial situation is not sufficient now or in the future and insolvency has already occurred or is imminent, there are grounds for filing for insolvency.

There are now many types of insolvency proceedings, whether self-administered insolvency, protective shield proceedings or insolvency plan proceedings, we are at your side to support you.

We work internationally and on an interdisciplinary basis with various national and international experts, in particular from the fields of operational restructuring, insolvency law and (distressed) M&A.

Options review and independet business review (IBR)
