Slovenia: The SARS-COV-2 (ZIUOOPE) emergency intervention and elimination measures act

Starting 1 of June 2020, in Slovenia entered into force the following measures:

 

 

 

FINANCIAL INCENTIVES UNDER THE COVID-19 FINANCIAL INCENTIVES PROGRAM

  • Financial incentives in the form of grants and repayable funds to ensure the current operations and liquidity of companies and adequate security or safe operations of companies in order to prevent the spread of COVID-19, to co-finance revenue shortfalls in tourism and hospitality, to provide support to manufacturing in border areas, to ensure the digitalisation and digital transformation of companies and for development projects in progress or with the potential for rapid start-up;
  • Beneficiaries are micro, small and medium-sized enterprises and large enterprises facing the negative consequences of the COVID-19 epidemic, which receive an incentive in the form of a percentage of project funding, a flat rate or other simplified forms of costs;
  • The financial incentive is granted on the basis of an application submitted by the beneficiary to a public tender or public invitation or in accordance with the procedure with a direct contract in accordance with the Public Finance Act. It is awarded in the form of a percentage of project funding, a lump sum or other simplified forms of costs;
  • On the day of submission of the application, the beneficiary must meet all the conditions set out for each form of state aid by the Temporary Framework for State aid measures in support of the economy in the event of an outbreak of COVID-19 (OJ C 91, I of 20.3.2020). address in the Republic of Slovenia and to have paid overdue liabilities from obligatory duties and other monetary non-tax liabilities on the day of submitting the application.

 

PROVIDING LIQUIDITY OF COMPANIES THROUGH PUBLIC FUNDS

  • The Slovenian Enterprise Fund and the Slovenian Regional Development Fund will be enabled to receive earmarked assets and use them for liquidity assets for micro, small and medium-sized enterprises;
  • Dedicated assets can be reduced to a minimum of earmarked assets.

 

INCREASING THE AMOUNT OF ESTIMATED VALUE FOR PUBLIC PROCUREMENT

  • Until 15 April 2021, the contracting authority may use the low-value procurement procedure, which does not require notification to the Publications Office of the European Union for public procurement of goods and services, and the public works contract if the value of the public contract is lower. from 1,000,000 euros;
  • Until 15 April 2021, a correction mechanism is also allowed if an economic operator fails to comply with mandatory duties and other monetary non-tax obligations in accordance with the law governing the financial administration collected by the tax authority in accordance with the regulations of the country in which it has the place of business, or the regulations of the country of the contracting authority, if the value of these outstanding due obligations on the day of submission of the tender or the application or verification is EUR 50 or more, or if on the date of submission of the tender or application or verification this entity has not submitted all withholding tax returns for the period of the last five years to the date of submission of the tender or application. In this case, the contracting authority shall set a reasonable time limit within which the economic operator must fulfill the obligations. This period may not exceed 30 days.

 

PROVISION OF FINANCIAL RESOURCES TO SID BANK FOR THE PURPOSE OF FINANCING ECONOMIC ENTITIES IN THE FIELD OF ROAD TRANSPORT

  • In order to maintain the operation of companies and preserve jobs in the road transport industry, SID Bank and the Republic of Slovenia agree on the financial engineering measure referred to in the fifth paragraph of Article 106f of the Public Finance Act. financing of economic entities in this field, namely for the purposes of financing investments or working capital.

 

ASSISTANCE TO PUBLIC TRANSPORT PROVIDERS (Article 43 ZIUOOPE)

  • Valid contracts or valid framework agreements for the implementation of special regular services, concluded with effect until 1 September 2020 with economic operators who, due to state measures and the spread of the disease during the declared epidemic of COVID-19, in the Republic of Slovenia , the provision of services under existing contracts or framework agreements is prevented or significantly hampered, may be extended without a call for tenders until 1 September 2021.

 

FIELD OF AGRICULTURE, FORESTRY AND FOOD

  • In 2020, an alien can obtain a permit for seasonal work in agriculture or forestry for a maximum of 150 days.

 

INCREASE OF SALARY SALARY FOR THE DISABLED

  • For companies with disabilities, the monthly request for the payment of a wage subsidy for an individual disabled person is increased by 10 percent of the minimum wage.

 

CO-FINANCING OF STAFF SCHOLARSHIPS

  • The employer is not obliged to return the received amount of co-financing of the staff scholarship for the scholarship holder who terminated the employment contract, whereby the employment relationship lasted less than one year, if he declares that he terminated the employment contract due to exceptional circumstances related to the Covid-19;
  • Within one year after the termination of the employment contract, the employer must offer the scholarship holder an employment contract for a suitable job, the duration of which, together with the duration of the terminated employment contract, is at least one year;
  • If the scholarship holder is already employed by another employer, the employer proves this by stating that the scholarship holder does not accept the offer due to employment. An employer who acts in breach of this obligation must reimburse the full amount of co-financing received for the staff scholarship for that fellow.
