Ukraine: Implementation of BEPS starting in 2017

According to the information which appeared on the official website of the Ministry of Finance of Ukraine end of November, Ukraine joins the implementation of Base Erosion and Profit Shifting (BEPS) action plan from January 01, 2017. The official letter with Ukraine’s commitment to implement the BEPS plan was handed over by the Finance Minister of Ukraine to OECD Secretary-General on 22 of November 2016.

According to the Ministry of Finance, Ukraine committed to implement 4 actions of the BEPS action plan, namely:

countering harmful tax practices,
preventing tax treaty abuse,
disclosure of aggressive tax planning and
cross-border tax dispute resolution.

As of today, no changes to the effective tax legislation of Ukraine have been developed into draft laws envisaging comprehensive implementation of the above actions of the BEPS plan. In case such changes are passed during 2017, one may expect the changes to apply not earlier than from 2018.
