The armed conflict in Ukraine affects directly the local population and indirectly the entire world, through its multiple effects. In March of this year alone, 74 visas and 27 residence permits were granted to Ukrainian citizens. Between January 2010 and December 2021, more than 3,3 thousand Ukrainians registered residency in Brazil.

In this context, was published the Interministerial Ordinance No. 28 on 03 March 2022 by the Ministers of Justice and Public Security and Foreign Affairs, which regulates the granting of temporary visa and residence permit, for the purpose of humanitarian reception, to Ukrainians and stateless persons affected by the armed conflict in Ukraine. It should be noted that, if not renewed, the Ordinance will be in force until 31 August 2022.

The temporary visa may be requested abroad, at Brazilian embassies located in several capitals of European countries. After obtaining the visa, the individual will have 180 days to enter the national territory.

After crossing Brazilian border, the immigrant may apply for a temporary residence permit visa for up to 2 years. Please note that the Ukrainian citizens who are already in the national territory, may, regardless of their migratory status, apply for the same residence permit visa. At the end of the 2-year period, a residence permit for an indefinite period may be requested by the immigrant.

Furthermore, for the purpose of this regulation, it is granted the free exercise of work activity in Brazil to the immigrant who receives this visa.

Foreseeing a possible migratory wave, Rödl & Partner South America has joined forces with Humanitas Brasil-Ukraine, an organization that has the purpose of supporting the Ukrainian population. Our international and interdisciplinary experts will be pleased to assist you in case you are interested in the described situation.
