New forms for Online Trademark Filings released

In order to modernize and align the anachronistic intellectual property protection in Myanmar, 4 new IP Laws were enacted in 2019, comprising the Trademark, Industrial Design Rights, Patent and Copyright Laws which have not been implemented yet due to events which followed.

In late 2020, a soft opening period for the submission of existing trademarks has been initiated by the then newly created IP Department under the Ministry of Commerce. Previously, existing trademarks had to be substantiated by a newspaper announcement, the actual usage of the trademark as well as the application with the Registration of Deeds Office.

After the start of the soft opening period, which is still ongoing, owners of existing trademarks have been able to upload evidence of their trademarks to an online platform.

On 1 July 2022, the IP Department altogether published 19 forms for trademark filings which are bilingual and can be accessed through the homepage of the IP Department. Though there have been no further announcements regarding the end of the soft opening period, or as to when new trademark applications can be submitted by accredited IP Practitioners with the department, the publishing of the new forms indicates at least further developments in the field of IP protection in Myanmar.

For any questions regarding the IP Laws and registration procedures, our in-house lawyers which are also registered IP Practitioners, are happy to get in contact.
