New Regulations on Electronic Signatures and Trust Services in Vietnam

Decree No. 23/2025/ND-CP, issued on February 21, 2025 under the New E-Transaction Law 2023, establishes a legal framework for electronic signatures and trust services, replacing previous regulations.
     
The decree applies to individuals, organizations, and agencies using e-signatures, excluding specialized government-use signatures. The decree categorizes e-signature certificates into four types: root certificates, trust service provider certificates, public digital signature certificates, and specialized certificates.
    
The decree regulates key e-signature and digital signature certificate details, including:
  • issuing authority; 
  • holder identity; 
  • validity period (ranging from three to twenty-five years); and 
  • intended use. 
     
All legally established organizations, agencies, and authorized individuals are entitled to obtain digital signature certificates. Certificates issued to authorized individuals must specify their title and affiliated organization. Digital signatures and certificates can only be used within the authorized scope of the issuing agency or individual. Delegated or authorized signing must follow legal regulations, with the signatory’s title being reflected in the certificate.
     
Effective from April 10, 2025, the decree enhances cybersecurity and supports Vietnam’s digital transformation. Businesses should ensure compliance with the new requirements to maintain legal and operational security in digital transactions.​
